50-year-old man arrested as son fails to appear in court for trial

A 50-year-old man, Rafiu Ayantayo, who stood as surety for his son has been arrested for ‘perverting the course of justice’ after allegedly failing to produce him for trial.

Police charged Ayantayo on Thursday, March 28 before an Iyaganku Magistrate’s Court, Ibadan in Oyo state.

The Prosecutor, Inspector Toyin Ibrahim, told the court that Rafiu failed to produce his son, Biodun in court on March 26. Biodun had been charged with housebreaking and theft.

Ibrahim said Rafiu committed an offence contrary to Section 126(1) of the Criminal Laws of Oyo State, 2000. The defendant, however pleaded not guilty to the charge.

The Magistrate, Mrs Kausarat Ayofe, admitted him to bail in the sum of N50,000 and two sureties in like sum.

Ayofe held that one of the sureties must be a blood relation to the defendant. She adjourned the case until June 4 for hearing.

An Area Court sitting in Jos, Plateau State has sentenced a 31-year-old man, Sani Ukasha, to jail for failing to produce an accused person he stood for surety.

The defendant had earlier been arraigned in court for allegedly stealing seasoning cubes, but he was granted bail.

However, during the continued hearing he was nowhere to be found and the police prosecutor, Inspector Gokwat Ibrahim informed the court that the surety failed to produce the accused person in contravention of the State Penal Code.

Ukasha pleaded guilty to the charge and pleaded for leniency. In his ruling, Justice Shawomi Bokkos, sentenced the surety to three months imprisonment with an option of N10,000 fine.
